Modifications

An Oregon court generally has the authority to alter or modify the provisions stated in a divorce, custody, parenting time, or child support judgment assuming appropriate circumstances exist.  Assuming the court retains or obtains jurisdiction over the parties and the subject matter, the focus of modification is generally upon whether a change of circumstances has existed since the time of the last order or judgment.  Modification of support generally can be requested if there has been a change in such things as incomes, parenting time, or living expenses.  Modification of parenting time generally is guided by whether to do so is in the best interests of the child.  Modification of child custody is also guided by the best interests of the child but the moving party must first demonstrate that there has been a substantial change in circumstances.

Appeals

An important fact in your ability to appeal a decision is the manner in which the case was resolved.  If you settled your case out of court, the appellate process is by and large not available to you.  However, if your case was litigated and decided by a judge, then you generally have the ability to appeal the decision that was handed down.

There is an important matter of timing in appeals as the notice of appeal must generally be filed within 30 days of the entry of the judgment which is being appealed.  If you intend to appeal, it is extremely important that you seek the assistance of an attorney as soon as possible.
