Oregon Divorce Property Valuation and Division Lawyers

  • Oregon is not a community property state.  This means that assets obtained before you were married are generally not considered property that was acquired by both individuals, although the court has the authority to consider the existence of those assets in determining the overall equity of the division of the marital estate.  Oregon law provides a rebuttable presumption that both parties have contributed equally to the acquisition of property during the marriage.

  • It is important to note, however, that unmarried individuals who have lived together and accumulated assets do not have the presumption of equitable contribution related to the property and assets acquired during the relationship.  The focus in the valuation and division of property in these circumstances is on the intent of the parties in acquiring the particular assets.
