The state of Oregon, along with nearly every other state in the country, is a “no-fault” jurisdiction, which effectively means that an element of spousal fault, for example an extramarital affair, is not considered in the divorce proceedings.  If one party initiates the divorce process, the case can begin and end without any input from the other party.  It is imperative that if you are served with a divorce petition, you seek competent legal advice with us as soon as possible.

There is no specific rule on how long the divorce process lasts.  In general, it is rare for divorce proceedings to reach a full and complete conclusion in less than thirty days, and in some cases can remain pending for several months or more.  The duration and complexity of a divorce case is often directly related to the willingness of the parties to work collaboratively and reasonably with one another to achieve a just and fair resolution.  Oftentimes, an amicable settlement offers the most affordable and expedient resolution of a divorce.

Oregon law provides that once a divorce action has been initiated, the court has the authority to order temporary relief during the duration of your case including issuing temporary custody, parenting time, support and maintenance, attorney fees, as well as the interim disposition of property.  Oregon law now provides for the automatic entry of a financial restraining order upon the filing of a Petition for Dissolution.
